TAS Worker Declaration

TAPA defines TAS workers in the FSR and TSR.

TAS workers are Temporary Agency Staff or temporary workers.

Many companies say they do not have TAS workers. However, all requirements of the FSR and TSR are mandatory. The reason a TAS worker declaration is required is because business models change, and a company may employ TAS workers in the future. The alternative to a TAS Worker Declaration is a waiver… which would probably not be granted because it is too easy to fulfil.

What is the solution?

If a company has TAS workers, the company must meet the requirements as outlined in the FSR and TSR.

If the company does not have TAS workers, the company’s Human Resources procedures may simply say that TAS workers will be processed and managed in the same way as normal employees.

Caution!

Even though a company does not TAS workers, or writes the above statement in the Human Resources work procedures, the company must still meet one additional requirement that is unique to TAS workers:

The TAS worker is required to sign a statement that they do not have any pending legal cases and agree to work according to the security procedures of the company.

The easiest way to meet this requirement is to have the TAS worker sign a statement saying that, or include that statement in a work related document signed by the TAS worker. For example, most companies will have workers sign a document related to wages, banking information, emergency contact information, etc. Simply add a statement above the signature that says “I hereby affirm that I have no pending legal actions and agree to work according to the company’s security procedures”.

Alternative

An alternative to adding a statement to an existing Human Resources form is to create a TAS Worker Declaration printed on company letterhead or stationery. The TAS Worker Declaration should have the document title (TAS Worker Declaration) at the top followed by a statement such as: “I the undersigned confirm that I have no pending criminal actions and agree to work according to the company’s security work procedures.

Under the statement, print the date the document is signed, print the name of the TAS worker, and have the TAS worker sign the document.
